Terms and Conditions of Service

1. Introduction

These Terms and Conditions govern the provision of training services by SafetyWorks Training (“the Company”, “we”, “us”, “our”). By booking or attending any training course, clients and learners agree to be bound by these Terms.

These Terms apply to all services delivered directly by SafetyWorks Training and those delivered on our behalf by approved subcontractors.

2. Services

SafetyWorks Training provides forklift and associated workplace safety training, assessment, and certification services in accordance with current UK industry standards and awarding body requirements where applicable.

3. Bookings and Acceptance

All bookings must be confirmed in writing (email or booking form).

A contract is formed once SafetyWorks Training issues written confirmation.

It is the client’s responsibility to ensure that all information provided (e.g. delegate details, prior experience) is accurate.

4. Fees and Payment

Fees will be agreed at the time of booking and confirmed in writing.

Invoices are payable within the agreed payment terms (typically 14 or 30 days).

We reserve the right to withhold certification where payment has not been received in full.

5. Cancellations and Rescheduling

Cancellations made within 5 working days of the course may be subject to a cancellation fee of up to 100%.

Rescheduling requests will be accommodated where reasonably practicable.

SafetyWorks Training reserves the right to cancel or reschedule training due to unforeseen circumstances; in such cases, alternative dates or a refund will be offered.

6. Client Responsibilities

The client (employer or booking organisation) must:

Provide a safe and suitable training environment compliant with health and safety legislation

Ensure equipment used for training (e.g. forklifts) is safe, maintained, and compliant

Provide accurate information about delegates’ experience and capability

Ensure delegates are medically fit to undertake training

7. Learner Responsibilities

Learners must:

Follow all safety instructions and trainer guidance

Behave in a professional and respectful manner

Disclose any relevant medical conditions or learning needs

Wear appropriate PPE where required

Failure to comply may result in removal from the course without refund.

8. Certification

Certification is issued only where the required standards of competence are met

Certificates remain the property of SafetyWorks Training until full payment is received

We reserve the right to withhold or withdraw certification where standards are not met or misconduct occurs

9. Use of Subcontractors

SafetyWorks Training may use approved subcontractors to deliver training and related services.

Where subcontractors are used:

They are subject to due diligence, quality assurance, and monitoring processes

They must comply with all relevant legislation, standards, and awarding body requirements

They are required to adhere to SafetyWorks Training policies, including equality, safeguarding, and health and safety

Overall responsibility for service quality remains with SafetyWorks Training

10. Quality Assurance and Compliance

SafetyWorks Training operates robust quality assurance processes to ensure compliance with:

UK health and safety legislation

Industry best practice for forklift training

Funding and regulatory requirements where applicable

We reserve the right to observe, audit, and review all training delivery, including subcontracted provision.

11. Health and Safety

All training is delivered in accordance with relevant health and safety regulations

Risk assessments must be in place prior to training delivery

Training may be stopped if unsafe conditions arise

12. Liability and Insurance

SafetyWorks Training holds appropriate public liability and professional indemnity insurance

We shall not be liable for any indirect or consequential loss

Liability is limited to the value of the training services provided, except in cases of death or personal injury caused by negligence

13. Data Protection

Personal data will be processed in accordance with UK GDPR and the Data Protection Act 2018

Data will be used only for the purposes of delivering training and meeting legal or regulatory requirements

14. Complaints and Appeals

Complaints must be submitted in writing

All complaints and appeals will be handled in accordance with our formal procedures

We aim to resolve all complaints promptly and fairly

15. Force Majeure

SafetyWorks Training shall not be liable for failure to deliver services due to circumstances beyond our reasonable control, including but not limited to extreme weather, industrial action, or illness.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

17. Website Reference Clause

A current version of these Terms and Conditions is available on the SafetyWorks Training website – www.safetyworkstraining.com . By engaging our services, clients agree to the latest version published at the time of booking.

18. Review

These Terms and Conditions are reviewed annually and may be updated to reflect changes in legislation or business operations.
